General Terms and Conditions - House of Sound AG, 4056 Basel
1.Offers
a) Our offers on the Internet and in circulars, newsletters, catalogues and other advertisements are non-binding and subject to change. House of Sound AG expressly reserves the right to change, supplement or delete parts or the entire offer without prior notice and to temporarily or permanently cease publication of offers on the Internet and in print media.
b) The presentation of the products in the online shop does not constitute a legally binding offer, but corresponds to a non-binding online catalogue. By clicking on the "Order now" button, you place a binding order for the goods contained in the shopping basket. Confirmation of receipt of the order follows immediately after the order has been sent.
c) Our order confirmation is not a binding purchase contract. All offers are subject to availability. House of Sound AG reserves the right to withdraw from a purchase contract at any time free of charge. The purchase contract is only concluded upon delivery.
d) The stock or delivery time information is non-binding. Stock levels are constantly updated but may be delayed due to technical circumstances. The indicated delivery period is non-binding and we will endeavour to inform you as soon as possible in the event of delays. We do not engage in forward transactions and cannot be held liable for delays in delivery.
e) We cannot accept any responsibility for changes made by the manufacturer to the shape, colour, scope of delivery or accessories of an item.
2. Prices
The prices quoted are cash sales prices including VAT plus freight costs in Swiss francs. In the B2B area, the prices are quoted net excluding VAT. The prices are ex warehouse Basel. Prices are subject to change and errors excepted. Any transfer charges incurred shall be borne by the buyer.
3. Delivery
Delivery is ex warehouse Basel. The goods are usually dispatched by Swiss Post. It is possible to receive partial deliveries for a fee. Transport damage must be reported to the responsible carrier within 7 days of receipt. There are no delivery dates unless agreed in writing before the purchase with mutual agreement and clear possible consequences in case of non-compliance. We exclude any kind of compensation due to late delivery, as we are also dependent on third parties and have no influence on many factors. Delivery times stated in the webshop are without guarantee.
4. Product inspection
Complaints must be notified to the seller in writing within 7 days. The date of the postmark shall be decisive. After expiry of this period, complaints can no longer be processed. Returns will only be accepted after consultation and only if there is a verifiable defect in the product. Returns will only be accepted if the goods are returned in their original, unaltered packaging. Cash on delivery returns will not be accepted. House of Sound AG is not obliged to guarantee an automatic exchange of the item in the event of faulty or defective products.
5. Order cancellation/ Return of items
Cancellation of the order:
Orders will be processed as quickly as possible. The customer is entitled to withdraw from the purchase contract free of charge after a delivery delay of 3 months, unless it is a special order. In the case of a special order, there must be a delivery delay of 3 months beyond the delivery date stated in the order confirmation in order to withdraw from the purchase contract free of charge.
Returning an item:
Each item should have information on the specific return policy in the webshop. In principle, however, the following always applies: Items that we keep in stock as standard can be returned within Switzerland/ FL in unused condition and in the unopened original box within 14 days. The purchase price for the item (excluding any postage) will then be refunded in full.
On some standard stock products (including all stringed instruments) we offer a right of return within 14 days for a credit note (no money back) in new condition and a fee of 30.-- for the return processing.
If the goods have been used/tested or for any other reason no longer correspond to a new item, a possible return, which we are not obliged to do in this case, will only be possible with a discount.
Items that are specially ordered or specially manufactured for you can generally not be returned.
Goods ordered in unusual quantities, in particular quantities that significantly exceed our stock, cannot be returned.
We reserve the right not to grant a right of return for certain items. The processing of returns can take up to 7 days and cannot be completed immediately without prior notification in the store. There is generally no right of return on software, software-related items, spare and wear parts or second-hand items.
6. Payment
Payment can be made in advance, via Paypal, invoice, instalments, credit card or cash on delivery. Depending on the payment method, fees will be charged. These fees are charged to us by the respective payment provider (Paypal, Payolution) and do not represent any additional profit for us. The dispatch of orders by prepayment on the basis of electronically sent payment confirmations is not guaranteed. The decisive factor for the fulfilment of an order is the receipt of payment in the postal or bank account.

7. Reservation of ownership
The goods remain the property of House of Sound AG until the full purchase price has been paid. They may not be sold, given away, exchanged or modified. Particularly in the case of instalment purchases, the products may not be given away, sold or passed on; the products remain the property of the financing partner (MF Group, Unzer/Payolution) until full payment has been made.
8. Liability
Most of the appliances we sell are foreign brands and manufactured in accordance with CE, VDE etc. standards. The appliances may only be operated by qualified personnel and only via safety switches. We accept no liability for damage caused by improper installation or use.
9. Warranty
The warranty covers material defects. Overloading and/or consequential damage are not included in the guarantee. This is a "bring-in guarantee", i.e. the appliances must be returned to us or sent to us at the customer's expense. Unless otherwise agreed in the warranty certificate, the warranty is valid for 36 months from the date of purchase. Repaired appliances must always be delivered or sent to us with a written description of the damage in the original packaging. During the warranty period, material defects will be repaired free of charge. There is no entitlement to replacement with a new appliance or replacement appliances during the repair period. Devices for repair must be returned to House of Sound in their original packaging so that the devices have the best possible protection during transport.
If a manufacturer requires registration for a longer warranty period, this must be done. We are not liable for any warranty services that are not covered by the manufacturer/distributor due to a lack of registration. A possible manufacturer/distributor guarantee that is longer than 2 years and requires registration of the products is not covered by our 3-year guarantee until the end of the guarantee granted by the manufacturer/distributor if registration has taken place. For all products purchased from House of Sound AG, we grant - in addition to the statutory warranty - a total of 3 years warranty subject to the following conditions:
(Note: The statutory warranty is in no way restricted by the House of Sound 3-year warranty).
Only the original purchaser is entitled to the guarantee and it cannot be assigned or transferred.
a) House of Sound AG provides a guarantee for all defects that occur during the guarantee period and are demonstrably attributable to a material or manufacturing defect.
b) Excluded from the guarantee are all computer items and all wearing parts such as microphones, headphones, especially in-ears, strings, skins, lamps, spotlights, LEDs, sticks, cymbals, rechargeable batteries, cables, bags, cases, straps, pots, faders, laser diodes, pitch benders, keyboards, switches, all tubes (including built-in tubes), etc., as they are subject to wear and tear due to use or natural wear and tear.
c) Also excluded from the guarantee are Product defects that are due to incorrect operation or failure to observe operating instructions, improper use, improper use, overloading or lack of maintenance and care,- Damage and defects to the product caused by the use of third-party parts that are not original manufacturer parts,- Products on which unauthorised repair attempts have been made,- Products with deviations from target values that are insignificant for the usability of the product.
d) For all defects recognised under the warranty obligation, House of Sound AG will remedy the defect by repairing the defective product free of charge or replacing it with a technically flawless product. The choice of measure is entirely at the discretion of House of Sound AG. The replaced parts or products become the property of House of Sound AG.
e) Warranty claims must be made within the warranty period. The return of the products must be agreed with House of Sound AG. The original invoice or a copy of the invoice must be enclosed with the return as proof of the guarantee. We expressly ask you to refrain from returning products carriage forward. House of Sound AG will not bear the costs of returning defective or faulty products.
f) If the product is repaired during the warranty period, the warranty will neither be extended nor restarted.
10. Recognition
Telephone, written and verbal orders are only accepted from persons with legal capacity. In the case of minors without legal capacity, the consent of the legal guardian is assumed. The customer unconditionally recognises these terms and conditions with every telephone, verbal, electronic or written order.
